These Terms of Service ("Terms") govern your use of AtCheck, operated by Monique Grocia ("AtCheck", "we", "us", or "our"), based in New York, USA. By creating an account or using at-check.com, you agree to these Terms.

1. What AtCheck is

AtCheck is a review platform for Instagram-based businesses. It allows people who have purchased from Instagram sellers to leave verified, proof-backed reviews, and allows business owners to claim their profiles and respond to reviews.

2. Accounts

  • You must be at least 13 years old to create an account.
  • You are responsible for maintaining the security of your account.
  • You may not create accounts for the purpose of manipulating ratings or bypassing restrictions.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Submitting reviews

By submitting a review, you confirm that:

  • You have genuinely purchased from or transacted with the business you are reviewing
  • Your proof of purchase is authentic and unaltered
  • Your review reflects your honest, firsthand experience
  • Your review does not contain false statements of fact
  • Your review does not contain personal information about private individuals
  • Your review is not retaliatory, harassing, or posted with the intent to harm

Submitting false or fabricated proof of purchase, or reviews of transactions that did not occur, is a violation of these Terms and may result in permanent account termination.

4. Review moderation

All reviews are reviewed by our team before being published. We reserve the right to decline to publish or remove any review that violates these Terms or our content guidelines. We do not remove reviews solely because a business disagrees with the rating or content.

5. Business profiles and claiming

  • Business profiles on AtCheck may be created by us or by users who have purchased from a business.
  • The verified owner of an Instagram account may claim their profile by completing our verification process.
  • Falsely claiming a business profile that you do not own is a violation of these Terms.
  • Verified business owners may respond to reviews but may not edit or delete them.

6. Prohibited conduct

You may not use AtCheck to:

  • Post fake, fabricated, or incentivized reviews
  • Coordinate review campaigns to artificially inflate or deflate a business's rating
  • Harass, threaten, or intimidate business owners or other users
  • Scrape, copy, or reproduce AtCheck content without our permission
  • Attempt to circumvent our moderation or verification systems
  • Use the platform for any unlawful purpose

7. Content ownership and license

You retain ownership of the reviews and content you submit. By submitting content to AtCheck, you grant us a non-exclusive, royalty-free, worldwide license to display, store, and use that content to operate the platform.

AtCheck owns all other content on the platform, including the site design, copy, and code. You may not reproduce or distribute AtCheck's content without written permission.

8. Third-party content

Reviews represent the opinions of individual users, not the views of AtCheck. AtCheck is an interactive computer service under Section 230 of the Communications Decency Act and is not the publisher or speaker of user-submitted content. Users are solely responsible for the content they post.

9. Dispute and takedown requests

If you believe a review contains false statements of fact about you or your business, you may submit a takedown request to support@at-check.com. Please include the URL of the review and a detailed explanation of what is inaccurate. We will review all requests and respond within 5 business days.

10. Disclaimers

AtCheck is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of any review or content on the platform. Use of AtCheck is at your own risk.

11. Limitation of liability

To the fullest extent permitted by law, AtCheck and Monique Grocia shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, even if advised of the possibility of such damages.

12. Governing law

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New York.

13. Changes to these Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of AtCheck after changes take effect constitutes acceptance of the updated Terms.
